The First Phone Call

During your initial phone call, a nurse case manager will discuss the medical care and treatment that the mother and child received, and gather the information necessary for our legal team to conduct a preliminary review of your potential claim. What will I be asked? You will be asked about the details of the mother’s pregnancy, delivery, and the condition of the child at the time of delivery and shortly thereafter.

Some examples of questions that may be asked during this first consultation:

  • When did the mother begin her prenatal care?
  • Did the mother deliver at term?
  • Was the baby breathing on its own upon delivery?

If the child has already been diagnosed with a birth injury like cerebral palsy, then our nurse case managers may ask more specific questions such as:

  • When was the baby’s birth injury diagnosed?
  • What diagnostic tests were performed and what were the results?
  • Can you list the surgeries and therapies the child has had thus far?
