The mother of a Tennessee toddler has filed a medical malpractice lawsuit against the doctor who she claim neglected her child after birth.
According the Tennessean, Matthew Allen Marlin was born on June 13, 2009 with an irregular heart beat and gasping breaths. The complaint dictates that Dr. John W. O’Donnell III decided on his own that Marlin had no chance for survival and placed him into a plastic bin until the family decided what to do with the body. More than four hours went by before a nurse noticed that Marlin was still breathing and gasping for air.
Marlin received resuscitation therapy and was transferred to another hospital where he was given specialized care for three months.
The medical malpractice lawsuit claims that Marlin now suffers from brain injuries and other injuries and damages because O’Donnell was negligent and did not provide “timely and appropriate diagnosis, intervention, treatment, and care.”
Marlin’s mother seeks an unspecified amount of compensatory damages.
