The Vietnam Veterans of America (VVA) has filed a disability denial claim against two government agencies claiming they wrongfully discharged at least 22,000 veterans without paying them proper medical and disability payments.
The VVA claims in its veterans disability insurance denial lawsuit that the Department of Defense and Department of Homeland Security "systematically and wrongfully discharged" 22,656 service members on the basis of having a personality disorder - a preexisting condition in the eyes of the military - between the fiscal years 2001 and 2007, Courthouse News reported. Of those service members, more than 6,000 had served in imminent danger zones in the wars in Iraq or Afghanistan, or in the support of Operation Iraqi Freedom/Operation Enduring Freedom.
The VVA alleges that these discharges were done in order to avoid having to pay the service members any service-connected disability benefits or VA health care that they would have received if diagnosed with post-traumatic stress disorder, or any other service-connected ailment.
The Pentagon may have saved up to $12.5 billion in medical and disability payments by discharging the service members and leaving them ineligible for benefits.
