A former warehouse worker for McKesson Corp. is suing the company, claiming wage and hour law violations and noncompliance with state labor laws.
According to Law 360 (subscription required), Jess Zabala claims that McKesson, one of the nation’s largest pharmaceutical distributors, failed to pay hourly workers at its California distribution centers for missed meal breaks and did not provide adequate seating as required by state laws from January 2007 through September 2011.
“Zabala and other aggrieved employees never received a second meal break for shifts between 10 and 12 hours,” the lawsuit said. “Defendants had a duty to ensure that meal breaks were properly scheduled for plaintiff Zabala and other aggrieved employees, but failed to do so.”
Zabala is pursuing a putative wage-and-hour class action lawsuit, and seeks actual, consequential and incidental damages, as well unpaid wages, civil penalties, an injunction, and attorneys’ fees and costs.
