A class action consumer fraud lawsuit has been filed against Rite Aid Corp in New York Federal Court that claims the drugstore overcharged thousands of people who enrolled in its discount program for prescription drugs.
According to Law360 (subscription required), the consumer fraud lawsuit alleges that Rite Aid overcharged members of its Rx Savings Program who paid for generic prescription medications with health insurance were automatically charged their applicable insurance co-payment prices instead of the discounted prices promised by the store’s program.
Rite Aid advertises that consumers who use the savings program can save money on more than 500 listed generic drugs, regardless if they have health insurance or not. However, the drugstores’ computer systems instead automatically charged those with health insurance the higher co-payment price, according to the consumer fraud lawsuit.
"Rite Aid has thus failed to establish policies and practices that ensure its advertised Rx Savings Program prices are in fact the prices charged to its Rx Savings Program members," says the complaint.
The class action, which seeks to represent consumers affected since 2006, charges Rite Aid with unjust enrichment, breach of contract, and violation of New York State business law.
