Two companies that manufactured defective plumbing system equipment and sold it to thousands of customers will now pay millions of dollars following the settlement of a class action product liability lawsuit that was brought against them.
In front of a Minnesota federal judge, plaintiffs in the product liability lawsuit alleged that Radiant Technology Inc. – and its successor, Uponer Inc. - manufactured and sold RTI's F1807 Plumb Flex plumbing system using advertisements that claimed it worked reliably. However, the lawsuit claimed that these promises were made despite the use of faulty brass insert fittings that were prone to premature failures, reported Law360 (subscription required).
The plaintiffs alleged that the companies violated warranty agreements while also deceiving customers into purchasing the defective plumbing product.
RTI and Uponer ultimately agreed to settle the class action product liability lawsuit. Under the proposed conditions, the companies will pay up to $2.4 million in legal fees, while also paying for all reasonable damages and repairs that resulted from leaks caused by the defective plumbing system. The companies will also replace any RTI F1807 systems under certain conditions.
