A federal court has decided that a dangerous drug lawsuit against the makers of an anti-miscarriage medication used from the 1930s until the 1970s can proceed.
According to the Worcester Telegram & Gazette, 53 women originally brought the dangerous drug lawsuit against the makers of DES (diethylstilbestrol), a synthetic estrogen medication commonly prescribed in past decades to prevent miscarriages in pregnant women. DES was yanked from the market after it was found that women who were exposed to the drug in utero had a greater risk of developing vaginal cancer.
The new lawsuit is thought to be the first linking the drug’s usage with breast cancer in women over the age of 40. Following a two-hour hearing, Magistrate Judge Marianne B. Bowler of U.S. Federal Court in Boston denied a motion that had been raised by the drug manufacturer to dismiss the case.
It was also agreed that a mediator would be brought in to negotiate a settlement for the women who were hurt by the medication.
