Aetna Inc. is cooperating with the California Department of Insurance (CDI) to investigate consumer fraud that may have been committed against its members by Lap-Band centers associated with the 1-800-Get-Thin ad campaigns.
According to Law360 (subscription required), a representative from the CDI confirmed that it was probing one or more Lap-Band surgery centers in the Los Angeles area.
In early January, Democrats in the U.S. House of Representatives called for an investigation and hearings into Allergan Inc’s Lap Band, which were used in the center’s surgeries. They pointed out that the Food and Drug Administration had linked the gastric device to nausea, gastroesophageal reflux disease, stretching of the esophagus, vomiting and difficulty swallowing.
The LA-area centers have recently been hit with litigation ranging from consumer fraud to wrongful death.
