A couple is suing the makers of a baby sling after their three-month-old daughter died claiming the company’s product was responsible.
According to Courthouse News, Ann Heneghan placed her daughter in the Nojo Original Baby Sling while she was shopping for about 10-to-15 minutes in October 2004. When she removed her daughter from the sling and tried to put her in a car seat, she noticed the baby was unresponsive and called paramedics. While her daughter was resuscitated, she was later found to be brain dead and taken off life support.
Heneghan and her husband were initially told that the their daughter had died from Sudden Infant Death Syndrome (SIDS), but after contacting a medical examiner who conducted the original investigation the couple found out that their daughter’s death was instead the result of positional asphyxiation.
In their product liability lawsuit against Crown Crafts Infant Products, the couple claims that the company failed to warn customers that the baby sling was not meant to be used on children under 4 months due to the dangers of asphyxiation. They also claim that the sling was to cause for their daughter’s death.
