Depakote Lawsuit Leads to $1.6B Settlement

Abbott Laboratories has agreed to pay $1.6 billion to settle a dangerous drug lawsuit filed by federal and state governments alleging the drugmaker illegally marketed unapproved uses of the epilepsy drug Depakote.

The settlement is the second-largest in a number of multimillion dollar payouts in recent years stemming from a stricter enforcement by state investigators and the Justice Department against drug manufacturers who illegally promote their medications, according to the Washington Post.

Abbott Labs has also agreed to plead guilty to a criminal misdemeanor.

Although doctors can prescribe “off-label” drugs – unapproved by the U.S. Food and Drug Administration as “safe and effective” – drugmakers are prohibited from actively marketing their products for the same uses.
