Other Health Impairment Plans (OHI) for Disabled Students

Children with cerebral palsy and other birth injuries who do not qualify for an IEP or a 504 Plan may qualify for IDEA assistance under the category of “Other Health Impaired” (OHI). According to IDEA, OHI means having limited strength, vitality or alertness, including a heightened alertness to environmental stimuli that:

  1. result in limited alertness with respect to the educational environment, that is due to chronic or acute health problems such as asthma, attention deficit hyperactivity disorder, diabetes, epilepsy, a heart condition, hemophilia, lead poisoning, leukemia, nephritis, rheumatic fever, sickle cell anemia; and
  2. adversely affects a child’s educational performance.

Your school administrator can help you determine if your child qualifies as OHI.

If the school district refuses services to your child under IDEA, Section 504, or both, you have the right to challenge the school district through a legal hearing. If you do not agree with the outcome of the hearing, you may want to retain your own attorney to appeal the school's decision.
