Section 504 plans

Section 504 Education Assistance for Disabled Children  

Section 504 of the Rehabilitation Act outlaws discrimination against children with disabilities and requires public or private school programs and activities that receive Federal financial assistance to provide qualified children with “reasonable accommodations” i.e. untimed tests, special seating arrangements, and access to necessary services. If your child is not covered because his disability is less severe, he may be eligible for services under Section 504. Your school district is required to provide you with a copy of its Section 504 plan upon request. If the school district does not respond to your request for a copy, contact a regional office of the U.S. Department of Education Office of Civil Rights for assistance.

The Americans with Disabilities Act (ADA) requires all non-religious educational institutions to meet the needs of children with psychiatric problems and prohibits discrimination against such students.  If you think your special needs child has been denied education assistance that he or she needs, consider starting the process of getting your birth injury legal questions answered.
