Product Liability Lawsuits

Everyday products should make our lives easier, but this is not always the case. Some products can cause you harm or even death. If this happens, the companies who made and sold these products could be to blame. You may be able to file a lawsuit against these companies and receive financial compensation.

Filing a Product Liability Lawsuit

We rely on thousands of products each day to work properly, and fortunately, most of them do. If a product fails, it can unexpectedly cause serious injury, long-term illnesses, or death.

While some products become dangerous as they wear out or break down, many seemingly harmless products can pose a threat.

This is because companies make and sell products with serious defects or side effects — without informing the general public.

If you believe that a defective product led to your injury or illness, consider filing a product liability lawsuit. Legal assistance from product liability lawyers can help you receive compensation from the company that made the product.

Legal compensation can help you pay for:

  • Medical treatments
  • Follow-up care, such as therapy
  • Lost wages if you can no longer work

Products Facing Liability Lawsuits

In recent years many products have been linked to serious health problems — and high-profile lawsuits.

After the health risks became known, the companies that made and sold these products had to pay compensation to those they harmed. You may also qualify for this compensation if these products were to blame for your injuries.

The products listed below are only a few that have injured or killed innocent people in recent years. Consult our complete list of case types to learn more.

3M® Earplug Lawsuits

If you served in the military and were deployed to Iraq or Afghanistan between 2003 and 2015, you may have been issued earplugs linked to permanent hearing loss or impairment. During those years, the military supplied the now-discontinued 3M Dual-Ended Combat Arms™ Earplugs (CAEv2) without knowing their harmful effects.

The earplugs were said to be too short to be properly inserted into the ears, meaning they could loosen and become useless. It is speculated that 3M knew of these defects as early as 2000. The company has agreed to pay $9.1 Million to those who suffered hearing loss or impairment caused by the CAEv2 earplugs.

You may be able to receive compensation if you or a loved one:

  • Served in the U.S. military at any point from 2003-2015
  • Used standard-issue earplugs during your time of service
  • Have permanent hearing loss or impairment related to your military service

Just For Men® Hair Dye

Sokolove Law is no longer accepting Just For Men® hair dye cases.

Just For Men is a brand of hair dye products that can cause adverse allergic reactions. When the dye is applied to hair or face, it may cause long-term or permanent side effects.

Side effects of Just For Men hair dye include:

  • Burns and rashes
  • Eye irritation
  • Permanent skin discoloration
  • Swollen skin
  • Vertigo

Just For Men products are dangerous because they contain p-Phenylenediamine (PPD), a chemical that has been linked to irritation, asthma, and kidney failure. In some cases, the chemical can also send people into shock or kill them.

As of 2019, the companies that produce and sell Just For Men products are still facing lawsuits. Despite the potential health risks, major retailers such as Wal-Mart continue to sell the product.

Oral Sodium Phosphate

Oral sodium phosphate is often found in products used to clean the bowels. Bowel cleansing is usually needed before a colonoscopy and may also be required for other medical procedures such as surgery.

However, in 2014 the Food and Drug Administration (FDA) reported that some products containing oral sodium phosphate could be deadly.

At particularly high risk are over-the-counter drugs that contain oral sodium phosphate. These drugs can cause severe dehydration if more than the standard dose is taken.

Dehydration caused by oral sodium phosphate can lead to:

  • Heart issues such as arrhythmias
  • Kidney damage or failure
  • Death

Because of the serious health issues that can stem from even a single overdose, you may be able to take legal action. Companies that made and sold drugs with oral sodium phosphate — but did not properly warn of the risks — could be responsible for your health issues.

Poligrip, a denture cream manufactured by GlaxoSmithKline, once contained high levels of zinc. Though small amounts of zinc are helpful in the human body, too much zinc can be very harmful.

It would take years of using Poligrip excessively for zinc levels to build up to become dangerous, but sadly, this happened in hundreds of people.

Reports claim that GlaxoSmithKline did not adequately warn consumers about the zinc in their products or the health risks if it was used excessively.

Poligrip can cause:

  • Blood disorders
  • Fatigue
  • Headaches
  • Loss of bowel control
  • Nausea and vomiting
  • Numbness and loss of feeling in limbs
  • Paralysis

Poligrip lawsuits came to a head in 2010 when the company faced over 100 lawsuits. The company paid around $120 Million to resolve the claims. Today, Poligrip no longer contains zinc.

Talcum Powder

Talcum powder has been in use for over 100 years, but its history is marred with controversy. Since the 1960s, there has been a growing amount of evidence that links talcum powder to different forms of cancer.

In particular, baby powder sold by Johnson & Johnson® may cause women to develop ovarian cancer. Baby powder was marketed toward women as a deodorant, a cooling agent, and an essential product for child care.

Recent investigative reports allege that Johnson & Johnson:

  • Knew their baby powder could possibly cause cancer
  • Actively worked to downplay or conceal negative reports and studies
  • Produced counter-studies with predetermined, favorable outcomes

The company lost a major lawsuit in 2018 when a Missouri verdict awarded 22 women nearly $4.7 Billion. All of the women claimed to develop ovarian cancer from using Johnson & Johnson baby powder.

As of 2019, Johnson & Johnson continues to face thousands of lawsuits surrounding the safety of their products.
