About the ByHeart Formula Recall Lawsuit 2025-2026

Multiple babies who consumed ByHeart Whole Nutrition Infant Formula were diagnosed with infant botulism, prompting a nationwide ByHeart formula recall.

Infant botulism occurs when babies ingest spores of the bacteria Clostridium botulinum. Health officials are investigating whether ByHeart formula may be contaminated with this bacteria, which can put infants at risk of serious illness.

On November 8, the company voluntarily recalled two batches of formula. By November 11, the recall was expanded to include all ByHeart Whole Nutrition Infant Formula products, including cans and single-serve Anywhere Pack sticks.

To date, at least 51 infants across 19 states have been hospitalized with botulism after consuming ByHeart formula, according to the U.S. Centers for Disease Control and Prevention (CDC). At least 10 of these cases occurred between December 2023 and July 2025.

At Sokolove Law, we’re committed to helping families seek justice for botulism linked to baby formula. Contact us now to find out if we may be able to help you.

Symptoms of Infant Botulism from ByHeart Formula

Infant botulism is a rare but serious condition that affects the nervous system and can be life-threatening if left untreated.

It may take several weeks for symptoms to appear, so it’s important to continue monitoring your child’s health after they’ve consumed ByHeart formula.

Symptoms of infant botulism may include:

  • Constipation
  • Decreased facial expressions
  • Difficulty swallowing
  • Drooping eyelids
  • Neck muscle weakness, leading to loss of head control
  • Poor feeding
  • Weak or altered cry

“ByHeart brand formula is disproportionately represented among sick infants in this outbreak, especially given FDA's data that ByHeart represents an estimated 1% of all infant formula sales in the United States.”
– U.S. Centers for Disease Control and Prevention

In severe cases, infant botulism can progress to respiratory arrest and death. Seek medical care right away if your child had ByHeart formula and begins showing any of these symptoms.

Who Can File a ByHeart Formula Lawsuit?

Legal options may be available to the parents and caregivers of children who were affected by contaminated baby formula.
