Cases Alaska Birth Injury Lawyers Handle

A birth injury can occur before, during, or soon after a baby is born. Families may be able to take legal action when a doctor, nurse, hospital, or other provider fails to respond appropriately to a complication or makes an avoidable error.

An Alaska birth injury lawyer can review the circumstances surrounding your child’s injury, including their medical records, to determine if the care they received fell below accepted medical standards.

Alaska birth injury attorneys may be able to help with these conditions:

Some birth injuries are temporary and respond well to treatment, while others can affect a child for the rest of their life. Severe injuries may lead to ongoing medical appointments, physical or occupational therapy, and other long-term needs.

“Our son was in the birthing canal for more than 10 minutes without oxygen, and he was put on life support. Miraculously, he lived but was diagnosed with CP. He cannot swallow or hold his head up. The compensation we received will provide care for his whole life.”
– Alaska Parent & Firm Client

If you believe a medical error played a role in your child’s injury, our Alaska birth injury lawyers can examine the care provided, identify potentially responsible parties, and explain your family’s options for pursuing compensation.

Understanding Birth Injuries & Medical Malpractice

Medical providers are expected to follow certain standards of care when treating a mother and baby. If a provider’s actions fall below that standard and a child is harmed as a result, the family may have grounds for a medical malpractice claim.

Negligence can happen at different stages of pregnancy, labor, and delivery. A provider might overlook signs of a complication, fail to act when a baby’s condition changes, or make a preventable error while assisting with delivery.

Examples of medical negligence linked to birth injuries may include:

  • Applying too much force during delivery
  • Delaying a medically necessary C-section
  • Failing to identify or properly address known pregnancy or delivery risks
  • Ignoring or inadequately responding to signs of fetal distress
  • Improperly using forceps or vacuum extractors
  • Not diagnosing or incorrectly diagnosing a serious condition
  • Withholding cooling therapy for a newborn with signs of HIE

Proving malpractice involves more than showing that a child was injured. The evidence must establish that the care provided was inadequate and that failures caused or contributed to the child’s harm.

Sokolove Law has registered nurses on staff who understand labor and delivery care. They can help families understand medical terminology and records while helping our legal team spot potential issues with the care provided.

Beth Carter, Registered Nurse with Sokolove Law

"There's a lot of medical terms being thrown around, a lot of tests being done, and you can kind of get lost in everything that's happening. Sometimes so much is happening that you don't get an explanation as to what is going on or what different things mean, different phrases, different terms, different tests."
– Beth Carter, Registered Nurse with Sokolove Law

An Alaska birth injury lawyer can investigate the circumstances surrounding your child’s injury and determine whether medical negligence may have been involved. Call (800) 995-1212 for a free case review and learn about your family’s legal options.

Who Qualifies for an Alaska Birth Injury Lawsuit?

A birth injury lawyer may be able to help your family file a lawsuit if medical negligence before, during, or shortly after delivery played a role in your child’s injury.

To have a valid Alaska birth injury claim, your lawyer generally needs to establish that:

  • A doctor, hospital, or other provider owed the mother or baby a duty of care
  • The provider’s actions fell below the accepted standard of care
  • The medical error caused or contributed to the child’s injury
  • The injury resulted in damages, such as medical expenses or ongoing care needs

Evidence like medical records, fetal heart monitoring strips, medication records, delivery notes, and test results can help show what happened. Medical experts may also review the evidence to determine how the care compared with accepted standards.

An Alaska birth injury lawyer can gather and evaluate this evidence and determine whether your family may be eligible to pursue compensation.

Alaska Birth Injury Statute of Limitations

The Alaska birth injury statute of limitations generally gives families 2 years to file a medical malpractice lawsuit (Alaska Stat. § 09.10.070).

Different rules can apply when the injured patient is a child. Under Alaska Stat. § 09.10.140, if a child was under age 8 when the injury occurred, the time before their 8th birthday generally isn't counted toward the 2-year filing period.

Wrongful death claims are also generally subject to a 2-year deadline under Alaska law. However, the exact amount of time available can depend on the circumstances of the case.

Birth injury deadlines can be complicated, and waiting too long may prevent your family from recovering compensation. An Alaska birth injury lawyer can determine which deadline applies and when it starts.

Call (800) 995-1212 now to see if you may be able to file an Alaska birth injury lawsuit. It costs nothing to speak with our team.

Steps to File an Alaska Birth Injury Lawsuit

Filing a birth injury lawsuit in Alaska starts with determining how your child was harmed and whether medical negligence played a role. From there, your legal team can gather evidence and seek compensation for the harm your family has experienced.

An Alaska birth injury lawsuit generally involves:

  • Getting a free case review from an experienced birth injury attorney in Hawaii
  • Collecting evidence like medical records to link your child's injury to negligence
  • Filing your claim before Alaska's filing deadlines
  • Negotiating a birth injury settlement, or fighting for a trial verdict in rare cases

Our Alaska birth injury lawyers can manage the legal process from start to finish while your family focuses on your child.

1. Contact Sokolove Law

When you reach out to Sokolove Law, we'll ask you to tell us what happened during your pregnancy, labor, and delivery. We’ll ask about your child’s diagnosis, treatment, and the circumstances surrounding their injury.

If medical negligence may have been involved, an Alaska birth injury lawyer can explain your legal options and next steps. Get started with a free, no-obligation case review.

2. We’ll Gather Evidence of Malpractice

Our legal team can collect evidence to build a clearer picture of the care you and your baby received.

Evidence in an Alaska birth injury case may include:

  • Fetal heart monitoring strips
  • Hospital and delivery records
  • Imaging and laboratory test results
  • NICU records
  • Prenatal and postpartum records

We may consult medical experts who can evaluate this evidence and determine whether the care provided was inadequate or contributed to your child’s injury in any way.

"We know what records to request, what experts to bring in, and how to build a strong case early, so the defendants know, right away, what they are up against."
– Ricky LeBlanc, Managing Attorney of Sokolove Law

3. We’ll File Your Alaska Birth Injury Claim

Once we understand what happened, our attorneys can identify the doctors, hospitals, or other health care providers who may be responsible and calculate the financial impact of your child’s injury.

This may include current medical bills as well as anticipated costs for future treatment, therapy, specialized equipment, home modifications, and assistive care.

Our team can then prepare and file your lawsuit within Alaska’s statute of limitations and handle communications with the defendants, their attorneys, and insurance companies.

4. Secure Alaska Birth Injury Compensation

Many medical malpractice cases are resolved through settlement negotiations. Our attorneys can pursue compensation that reflects both the immediate and long-term effects of your child’s injury.

If the defendants do not agree to a fair settlement, we can continue building the evidence and prepare to take the case to trial. Alaska medical malpractice cases may also involve review by a court-appointed expert advisory panel as the lawsuit moves forward.

Our Alaska Birth Injury Settlements & Verdicts

Compensation from an Alaska birth injury lawsuit can help address the financial impact of a preventable injury, including expenses a child may face years into the future.

  • $16.5 Million for the family of a child with cerebral palsy
  • $7.8 Million for a child who developed CP from a birth injury
  • $6 Million for the family of a child with CP brain injury
  • $5 Million for a child who suffered brain damage during delivery

  • $4.1 Million for a child who suffered umbilical cord strangulation and fetal distress
  • $8 Million for a child with a vacuum extractor injury
Over $10.4 Million for the family of a child with cerebral palsy

Alaska law generally limits noneconomic damages in medical malpractice cases to $250,000. The limit increases to $400,000 in cases involving wrongful death or a severe permanent physical impairment that is more than 70% disabling (Alaska Stat. § 09.55.549).

These limits apply to losses such as pain and suffering. However, economic damages can cover financial losses like medical bills, future care, and reduced earning ability.

Every case has its own circumstances, and past results do not guarantee a particular outcome. Our Alaska birth injury lawyers can assess your child’s current and future needs and pursue the compensation your family may be entitled to.

$6 Million Alaska Birth Injury Award Reviewed

In September 2026, a federal appeals court reviewed a more than $6 Million award to the family of a child who suffered a permanent brachial plexus injury during delivery at a military hospital in Fairbanks.

The baby experienced shoulder dystocia, which occurs when one or more of the shoulders get stuck behind the mother's pubic bone. The doctor is accused of using excessive lateral traction on her head while attempting to complete the delivery.

A federal district court found the doctor negligent and reckless, awarding the family more than $6 Million in damages. Evidence showed the doctor applied roughly 40 pounds of lateral force, despite testimony that the standard of care called for no more than 5 pounds.

The 9th Circuit upheld the finding of recklessness but ordered the lower court to reconsider the award of damages. The case was sent back to the district court to determine a revised award.

Alaska Supreme Court Rules in Birth Injury Malpractice Case

The Alaska Supreme Court ruled in a medical malpractice case involving a child who was diagnosed with hypoxic-ischemic encephalopathy (HIE) after being born at Fairbanks Memorial Hospital.

The child later developed cerebral palsy, seizures, microcephaly, and developmental delays. The mother alleged that negligent care during labor and delivery caused brain damage and sued a nurse-midwife, an obstetrics practice, and the medical group operating the hospital.

The court ruled for the defendants after the family’s Alaska birth injury lawyers failed to file timely responses to their motions. The decision did not determine whether negligent medical care caused the child’s birth injuries.

Family Files Alaska Birth Injury Lawsuit after Baby's Stillbirth

The Alaska Supreme Court upheld the dismissal of a lawsuit filed by the parents of a stillborn child against the midwives who attended the birth.

The family alleged they were not adequately informed about the risks of delivering at a birth center with a midwife instead of at a hospital with a physician.

However, the court found the parents did not provide sufficient evidence showing that the midwives’ care caused the stillbirth.

Compensation from a birth injury lawsuit can help families cover medical treatment, therapy, assistive equipment, and other costs associated with a child’s ongoing care.
