Over 9,500 Successful Asbestos Exposure Cases in All 50 States

Asbestos Exposure & Lung Cancer in Mississippi

Thousands of Mississippi workers spent their careers in shipyards, oil refineries, and industrial plants, breathing in asbestos fibers they were never warned about. Decades later, some are dealing with asbestos-related illnesses like lung cancer and mesothelioma.

Mississippi had one of the highest rates of annual lung cancer diagnoses at 68.7 per 100,000, trailing only Kentucky and West Virginia, according to the American Lung Association. The state's own legislature has formally acknowledged the role asbestos plays in that toll.

“Asbestos is a mineral that was widely used for insulation, fireproofing, and other purposes. Exposure to asbestos has been causally associated with mesothelioma and lung cancer, as well as nonmalignant conditions such as asbestosis.”
– Mississippi’s Asbestos Transparency Trust Act (MS HB1426)

At least 1,104 Mississippi residents passed away from asbestos lung cancer between 1999 and 2017, according to the Environmental Working Group.

Our Mississippi lung cancer lawyers can help families seek compensation for medical bills, lost wages, and more. While the average lung cancer payout is around $100,000, some of our clients have received over $1 Million.

Who Can File a Lung Cancer Lawsuit in Mississippi?

You may be able to file a Mississippi lung cancer lawsuit if you or a loved one was diagnosed with this cancer after being exposed to asbestos.

Those who may qualify to take legal action include:

  • Lung cancer patients
  • Their immediate family members
  • The representative of a patient’s estate

Lung cancer patients with a history of smoking may still be eligible for compensation from any asbestos-related companies that played a role in their illness.

”Smoking can cause lung cancer. So can exposure to asbestos. Tobacco smoke and asbestos actually operate with a synergistic effect, meaning that your likelihood of developing cancer is multiplied if you’re a smoker who was exposed to asbestos.”
– Ricky LeBlanc, Managing Attorney at Sokolove Law

If your loved one has already passed away from lung cancer, you may be able to seek justice on their behalf by filing an asbestos claim after their death.

Statute of Limitations on Mississippi Lung Cancer Claims

In Mississippi, you only have a limited amount of time to take legal action for an asbestos lung cancer diagnosis due to laws called the statute of limitations.

The statute of limitations on Mississippi lung cancer claims is 3 years after your diagnosis, according to Miss. Code Ann. § 15-1-49. If a loved one has passed away from lung cancer, their family has 3 years from the date of death to file a wrongful death claim, per Miss. Code Ann. § 11-7-13.

Once this deadline expires, you may lose your chance to take legal action and pursue compensation. It’s important to contact a Mississippi lung cancer attorney as soon as possible.

Our Mississippi Lung Cancer Settlements & Verdicts

At Sokolove Law, we’ve secured more than $5.9 Billion for clients with lung cancer and other asbestos-related diseases, including for families in Mississippi.

Some of our past asbestos lung cancer settlements and verdicts include:

  • $760,000 for a Hattiesburg lung cancer patient who was exposed to asbestos in boiler rooms
  • $1.6 Million to a plumber and his wife who were both diagnosed with lung cancer
  • $1 Million for a master electrician
  • $912,000 to a non-small cell lung cancer patient
  • $2.18 Million for a Batesville plant worker with pleural mesothelioma
  • $825,000 to a steel mill worker
  • $1.49 Million for a U.S. Air Force veteran in Vicksburg with mesothelioma
  • $757,000 to a steelworker with asbestos lung cancer
  • $809,000 for a stage 4 lung cancer patient
  • $3.63 Million to a Picayune welder with mesothelioma
  • $902,000 for the brother of a construction worker with non-small cell lung cancer

Payouts from a lung cancer lawsuit come from the companies that made or sold asbestos-containing products. Many of these companies knew about the risks but chose to stay silent.

“Manufacturers of asbestos-containing products put profits ahead of people and didn’t inform workers of these dangers.”
– Jim Sokolove, Firm Founder (Retired 2013)

Asbestos Exposure at Ingalls Shipbuilding in Mississippi

Founded in 1938 on the east bank of the Pascagoula River, Ingalls Shipbuilding grew from a commercial shipyard into one of the most important naval contractors in the United States — and it became a primary source of asbestos exposure for many Mississippi residents.

At its peak in the 1970s, Ingalls employed over 27,00 workers. Shipyard employees built a significant portion of the U.S. Navy’s warships, which were often filled with asbestos-containing insulation, gaskets, lagging, and valves.

By 1994, more than 3,100 former Ingalls workers had filed asbestos lawsuits against the shipyard.

In the case of Overly v. Ingalls Shipbuilding (1999), court records showed that Ingalls representatives attended a 1942 U.S. Maritime Commission meeting on the hazards of asbestos at shipyards, but they failed to warn workers about these risks.

Mississippi Lung Cancer Lawsuit Updates & News

Asbestos lung cancer lawsuits continue to move forward in Mississippi as victims and their families seek justice for decades of exposure at the state's shipyards, steel mills, and industrial facilities.

Find out more about Mississippi lung cancer lawsuit updates and news:

  • Asbestos was removed from aging facilities at Mississippi Valley State University before the buildings were demolished, underscoring the fact that the risk of lung cancer from asbestos exposure remains present in older buildings across the state.
  • A Mississippi woman was awarded $3.85 Million after her husband was exposed to asbestos at work and passed away from lung cancer.
  • Multiple major asbestos-related companies agreed to a $160 Million settlement for victims with illnesses like lung cancer. The case involved at least 246 Mississippi residents.

Some of these cases have resulted in significant verdicts and settlements, helping families recover compensation for medical bills, lost income, and more. Find out more about Mississippi asbestos lung cancer lawsuit news and updates.

$3.85 Million Mississippi Lung Cancer Verdict

From 1966 to the 1980s, Larry Smith worked in the drilling industry in Mississippi. In this role, he was repeatedly exposed to drilling mud additives that were nearly 100% asbestos, according to court documents.

Smith developed lung cancer and passed away just 3 months later. His wife filed a Mississippi lung cancer lawsuit against the companies responsible for his exposure, including Union Carbide, Montello, and Chevron Phillips.

After a 3-week trial, a jury awarded his estate $3.85 Million, finding that the defendants' asbestos-containing drilling products were the main cause of his lung cancer — even though he was also a heavy smoker.

$160 Million Asbestos Settlement in Mississippi Courts

A group of 18 asbestos-related companies agreed to settle 2 major personal injury lawsuits filed in Mississippi state court, David Cosey v. E.D. Bullard and LeRoy Rankin Jr. v. A-Bex Corporation. In total, the asbestos lawsuits involved nearly 4,000 plaintiffs from 5 states.

The cases had migrated to Mississippi in part because, at the time, juries there rarely ruled against claimants in product liability cases. Lawyers were also able to bring in thousands of out-of-state plaintiffs once a single Mississippi resident filed suit, per the New York Times.

The companies, organized under a group called the Center for Claims Resolution, agreed to pay $160 Million to victims with illnesses like lung cancer, mesothelioma, and asbestosis. Defendants included Armstrong World Industries, Union Carbide, and United States Gypsum.

Out of all of the plaintiffs, 246 were Mississippi residents with serious illnesses who received $263,000 each, according to the Sun Sentinel.
