What Is the Federal-Mogul Asbestos Personal Injury Trust?

For much of the 20th century, the companies that Federal-Mogul would later acquire manufactured asbestos-containing products used in a wide range of industries across the U.S. Many workers who came in contact with these products developed illnesses like mesothelioma.

By 2001, Federal-Mogul was facing over 400,000 asbestos lawsuits, prompting them to file for bankruptcy and establish an asbestos trust to pay those sickened. During the first 3 months of 2001, approximately 26,000 new claims were filed.

About the Federal-Mogul Asbestos Trust

  • The Federal-Mogul asbestos trust was established in 2007, approximately 6 years after the company filed for Chapter 11 bankruptcy protection in 2001.
  • The trust is composed of 4 subfunds: the Turner & Newall (T&N) Subfund, the FMP Subfund, the Fel-Pro Subfund, and the Vellumoid Subfund.
  • Each covers claims tied to a different Federal-Mogul subsidiary that manufactured asbestos-containing products like sprayed-on insulation, gaskets, and auto parts.
  • Construction workers, mechanics, electricians, U.S. Navy veterans, and factory workers are among those most likely to have been exposed to these asbestos-containing products.
  • In 1976, the first asbestos personal injury lawsuit in the U.S. was reportedly filed against Flexitallic, which was later acquired by Federal-Mogul.
  • The Federal-Mogul asbestos trust was funded with $635 Million, and you may qualify for a payout to help cover your medical bills, lost wages, and more.

Federal-Mogul asbestos victims diagnosed with mesothelioma, lung cancer, and other eligible asbestos-related illnesses, as well as their family members, may be entitled to compensation.

At Sokolove Law, many of our clients start receiving payouts from asbestos claims in as few as 90 days of contacting our team. We’ll fight hard to secure the compensation you deserve as quickly as possible.

Federal-Mogul Asbestos Products

Federal-Mogul Corporation didn't originally manufacture products with asbestos. However, in the 1970s, the Michigan-based company acquired several subsidiaries that used asbestos for decades, inheriting their product lines and liabilities.

Notably, Federal-Mogul added Turner & Newall (T&N) to their portfolio, a British conglomerate that had been one of the largest asbestos-related companies in the world since the 1920s. They also added Fel-Pro, Flexitallic Gasket Company, Ferodo, and Vellumoid.

Federal-Mogul asbestos products included:

  • Cement pipe and building materials
  • Disc pads, clutch facings, and brake linings
  • Gaskets and seals used in automotive and industrial applications
  • Spiral wound industrial gaskets
  • Sprayed-on fireproofing and insulation
  • Textiles, insulating mattresses, and pre-formed insulation
  • Thermal insulation products for ships, power stations, and industrial facilities

Asbestos allowed these products to resist extreme heat and friction. However, when they were installed, serviced, or removed, microscopic fibers may have become airborne and inhaled. Asbestos exposure can lead to serious diseases like mesothelioma 20-50 years later.

By filing a Federal-Mogul asbestos claim, victims and their family members can hold the company and others that sold asbestos-containing products without adequately warning of the risks accountable.

History of Federal-Mogul Asbestos Lawsuits & Liability

Before Federal-Mogul filed for bankruptcy, they were hit by thousands of lawsuits filed by factory workers, mechanics, and others who were seeking compensation from asbestos settlements after being sickened by the company’s products.

By the time of the company's bankruptcy in 2001, Federal-Mogul subsidiary T&N had been named in over 114,000 asbestos claims. Lawsuits against other subsidiaries brought the total to more than 400,000.

In just the first quarter of 2001 alone, Federal-Mogul paid $88.3 Million against their asbestos liabilities, on pace to exceed $350 Million for the year — with new claims still arriving at a rate of roughly 26,000 per quarter.

Federal-Mogul asbestos lawsuits alleged that the company's subsidiaries had known for decades about the dangers of asbestos but chose to continue manufacturing and selling asbestos-containing products — without warning workers or the public.

$35 Million Federal-Mogul Asbestosis Verdict

A Texas jury hit Federal-Mogul subsidiary Flexitallic and U.S. Gypsum Co. with a $35 Million asbestos verdict for failing to warn 22 workers diagnosed with asbestosis about the dangers related to their products.

Flexitallic manufactured an asbestos-based “spiral wound gasket” that was used in industrial plants to handle extremely hot or acidic liquids. In 1976, the first U.S. asbestos personal injury claim was reportedly filed against Flexitallic.

$75 Million Federal-Mogul Asbestos Verdict

A New York jury awarded $75 Million to a woman who developed mesothelioma linked to gaskets made by Felt Products Manufacturing Co., a Federal-Mogul subsidiary. She alleged that she had been exposed while helping her husband scrape and grind engine gaskets and while cleaning their garage and dusty clothes.

The victim's experts testified that the gasket dust contained several thousand times the "safe" level of asbestos, and even Federal-Mogul's expert agreed that the dust was 50-85% asbestos, according to reports.

The verdict included $50 Million for past and future pain and suffering and $25 Million for her husband's loss of services. Other asbestos-related companies named in the lawsuit included Crane, Georgia Pacific, Honeywell, and Owens Corning. Ultimately, an appeals court vacated $13 Million of the award.

$9.3 Million Federal-Mogul Mesothelioma Verdict

A Massachusetts jury awarded $9.3 Million to the wife of a pipefitters' union manager who died at 84 after being diagnosed with mesothelioma linked to Turner & Newall's Limpet spray insulation used to build Boston's Prudential Tower.

The mesothelioma lawsuit had been filed by the Federal-Mogul Asbestos Personal Injury Trust on the family's behalf. T&N had claimed that the punitive damages award of $6.2 Million was improper because the money would not actually go to the family but to the trust to benefit future claimants.

The mesothelioma verdict stems from a lawsuit that the pipefitter had filed against 90 asbestos-related companies that he blamed for his asbestos exposure.

$1.2 Million Federal-Mogul Flexitallic Asbestos Verdict for Wrongful Death

A Louisiana court awarded $1.2 Million to the family of a U.S. Navy veteran who passed away from mesothelioma after being exposed to gaskets made by Flexitallic while he served.

The wrongful death lawsuit alleged that Flexitallic was negligent in failing to warn of the serious dangers connected with their products. The company’s gaskets could often be found on naval vessels in boilers, piping, and steam systems.

"For critical sealing applications in the Nuclear Navy, engineers depend on Flexitallic Gaskets," one advertisement read.

Asbestos trust fund claims have deadlines known as statutes of limitations, which limit how long you have to file a claim and seek a payout. This deadline usually starts when a patient is diagnosed with an asbestos-related disease or passes away from one.

Federal-Mogul Asbestos Settlement Trust Payouts

Many asbestos-related companies like Federal-Mogul established trusts to pay current and future victims sickened by their products. Claims funds pay out different amounts based on a patient's disease, the type of review used to evaluate the claim, and the subfund.

The T&N subfund includes claims involving the asbestos-related companies Turner & Newall, Flexitallic, and Ferodo.

Federal-Mogul asbestos trust payouts for T&N subfund claims may include:

DiseaseScheduled ValueAverage ValueMaximum Value
Mesothelioma$200,000$250,000$600,000
