The Palm Beach County coroner attributed the woman's death to “acute mitragynine intoxication.” Mitragynine is one of the two main chemical compounds in kratom.

The Kratom Distro lawsuit​ alleged that the defendants were responsible for the woman's death because they falsely marketed the product as an all-natural supplement and failed to warn of the potential dangers.

$2.5 Million Washington Kratom Divine Lawsuit​ Verdict

A Washington jury awarded $2.5 Million to the family of a 39-year-old Castle Rock man and father of 3 who died after consuming kratom.

The jurors found Society Botanicals LLC, which does business as Kratom Divine, as well as the company's owner, responsible for the man’s death.

The Kratom Divine lawsuit is reportedly the first jury verdict in a civil lawsuit for damages against a kratom manufacturer or distributor.

$8.75 Kava and Kratom Drink Lawsuit​ Settlement

Botanic Tonics agreed to pay $8.75 Million to settle a kratom class action lawsuit that claimed the company failed to disclose how much kratom is in their product and minimized the risks of consuming too much.

The product at issue, sold under the name "Feel Free," is a kratom and kava mixed tonic. The Feel Free kratom lawsuit alleged that the product was highly addictive even though it was marketed to people struggling with addiction.

On May 6, 2026, Feel Free and other kratom-containing products will be banned for sale in Utah. Lawmakers have attributed about 200 deaths in the state to the herb.

  • March 9, 2026: A Kansas couple filed a kratom lawsuit following the death of their son. The defendants, including Club 13 Inc., The Hub Smoke Shop, Wellness Connect, and OPMS Kratom, are accused of selling a dangerous product without proper warnings.
  • February 9, 2026: Texas Attorney General Ken Paxton sued kratom retailer Smokey’s Paradise, accusing them of selling products containing nearly 50 times the legal limit of the kratom compound 7-OH.
  • July 15, 2025: The FDA issued warning letters to 7 companies for illegally marketing kratom products to the public. The products included tablets, gummies, drink mixes, and shots.
  • December 2, 2025: A mother sued several kratom companies, blaming them for the death of her 38-year-old son. The Missouri kratom lawsuit alleges that the victim had an extremely high level of 3400 nanograms per milliliter of the active substance in his blood.
  • July 24, 2023: A jury in Washington state awarded $2.5 Million to a family in the first kratom wrongful death trial in the U.S.
