Who Can File a South Carolina Asbestos Claim?

Anyone exposed to asbestos who later developed mesothelioma or another asbestos-related disease may be able to file a claim. The foundation of any case is identifying how the exposure happened and which companies may be responsible.

A South Carolina asbestos claim attorney can help mesothelioma victims exposed on the job, during military service, at home, or elsewhere, as well as their family members.

Our South Carolina asbestos lawyers can help:

  • Patients diagnosed with mesothelioma, lung cancer, asbestosis, and other asbestos-related diseases
  • Family members, including spouses and children of the patient
  • Estate representatives pursuing wrongful death claims

Asbestos cases often require reconstructing a person's exposure history. Attorneys often examine decades-old employment records, military service records, and product evidence to identify the companies that may be responsible.

"Our primary role in the very beginning stages of a mesothelioma lawsuit is to be detectives. We have to find products that were around the victim during the time of their exposure to asbestos."
– Jim Sokolove, Founder (Retired 2013)

Not sure how you were exposed? Our South Carolina mesothelioma attorneys have experience tracing asbestos exposure that occurred decades ago in South Carolina and other states.

South Carolina Mesothelioma Statute of Limitations

All states have a statute of limitations, which is the deadline for filing an asbestos lawsuit after a diagnosis or death.

The South Carolina mesothelioma statute of limitations generally gives mesothelioma patients 3 years from the date of diagnosis to file a personal injury claim (S.C. Code § 15-3-530(5)). Families generally have 3 years from the date of death to file a wrongful death claim (S.C. Code § 15-3-530(6)).

Taking action quickly can make it easier to gather employment records, identify witnesses, and document exposure. Waiting too long could prevent you from filing a claim at all.

Call (800) 647-3434 right now to see if you may be able to file a South Carolina mesothelioma lawsuit. It costs nothing to speak with us.

What to Expect When Filing a South Carolina Mesothelioma Lawsuit

Families who pursue a mesothelioma lawsuit generally go through several steps to trace the exposure, identify responsible companies, and seek compensation.

Most South Carolina mesothelioma lawsuits are resolved through settlements rather than trials, allowing many families to secure compensation without the hassle of a courtroom battle.

Filing a South Carolina mesothelioma lawsuit generally involves:

  • Speaking with a mesothelioma lawyer
  • Identifying when, where, and how asbestos exposure occurred
  • Filing claims against the companies responsible
  • Negotiating settlement payouts
  • Going to trial if a settlement cannot be reached

Many Sokolove Law clients begin receiving compensation in as few as 90 days after approved claims are submitted. Additional compensation may follow over the coming months as other claims are resolved.

Our team can investigate:

Most mesothelioma cases are resolved through negotiated settlements rather than trials, helping families secure financial support sooner while avoiding court proceedings.

  • May 2006: South Carolina enacted the Asbestos and Silica Claims Procedure Act, establishing special procedures for asbestos lawsuits, including medical evidence requirements for most claims while giving priority to mesothelioma and other malignant asbestos-related diseases.

Compensation from a South Carolina mesothelioma lawsuit or settlement can help families cover medical bills and other expenses related to a mesothelioma diagnosis.

$63.3 Million in South Carolina Mesothelioma Talc Verdict

In 2024, a South Carolina jury awarded a mesothelioma patient and his family more than $63.3 Million after finding that Johnson & Johnson's baby powder caused his cancer.

The verdict included $32.6 Million for the victim's actual losses and $30.7 Million in punitive damages. Jurors also found co-defendant American International Industries liable.

The man was diagnosed with mesothelioma in 2023 after using J&J's talc-based baby powder every day because he was allergic to deodorants. The company allegedly knew as early as 1970 that their talc products contained asbestos.

$32 Million South Carolina Take-Home Asbestos Verdict

A family was awarded $32 Million after the death of a loved one from mesothelioma linked to asbestos brought home on the clothing of family members who worked at an industrial facility.

The verdict found Kraft Heinz Co. and Metal Masters Inc. negligent for failing to warn workers about asbestos hazards.

The victim was allegedly exposed to asbestos while laundering the work clothes of her husband, who worked for Metal Masters at a Kraft-owned Louis Rich facility in Newberry during the 1980s. She was also exposed through her father and uncle.

$1.75 Million South Carolina Mesothelioma Wrongful Death Verdict

In 2024, a South Carolina jury awarded $1.75 Million to the wife of a maintenance worker who died from mesothelioma after years of occupational asbestos exposure.

The jury found that exposure to asbestos-containing products at the Celanese plant in Spartanburg during the 1970s contributed to his illness. The case was heard by Judge Toal as part of the South Carolina asbestos docket.

The victim regularly replaced gaskets and packing on valves and pumps, which exposed him to asbestos in products manufactured by John Crane Inc. He was also exposed to asbestos while removing insulation to access equipment.

$2.87 Million South Carolina Mesothelioma Lawsuit Verdict

A power plant worker was awarded $2.87 Million after a South Carolina jury found that his mesothelioma was caused by exposure to asbestos-containing valves manufactured by Fisher Controls International and Crosby Valve LLC.

The man worked for Duke Energy and, during the 1980s, regularly supervised the removal and replacement of gaskets on Fisher and Crosby valves, according to the lawsuit.

After the jury returned its verdict, the trial court increased the award to $2.87 Million. The mesothelioma verdict was later upheld on appeal.

$1.1 Million South Carolina Mesothelioma Verdict

The estate of a paper mill worker who developed mesothelioma was awarded $1.1 Million after a jury connected his illness to years of occupational exposure to asbestos-containing dryer felts supplied by Scapa Waycross.

The worker spent years installing, cleaning, removing, and disposing of dryer felts on paper machines, with approximately one-quarter of those felts containing asbestos, according to the lawsuit.

He was diagnosed with malignant pleural mesothelioma about 10 years after retiring and later died from the disease. In 2024, the South Carolina Supreme Court upheld the verdict.

$14 Million Mesothelioma Lawsuit Verdict for Worker's Family

A South Carolina jury awarded $14 Million to the family of a maintenance worker who died at age 70 from mesothelioma after years of asbestos exposure at a Celanese polyester fiber plant in Spartanburg.

The South Carolina mesothelioma wrongful death verdict included $12 Million for actual losses and $2 Million in punitive damages after jurors found Celanese negligent and reckless.

The victim worked at the plant from 1971 to 1980 while employed by a contractor, Daniel Construction Co. Celanese allegedly controlled safety policies but failed to warn workers about asbestos hazards or provide adequate protection.

"These companies always have knowledge of hazards the workers don't. By the time [the victim] started working at the Celanese plant, they had full information upon which they could have acted."

$29.1 Million South Carolina Asbestos Talc Mesothelioma Verdict

A South Carolina jury awarded $29.1 Million to a 36-year-old mother of three diagnosed with mesothelioma who alleged that asbestos-contaminated talc in cosmetic products caused her cancer.

Jurors found talc supplier Whittaker, Clark & Daniels liable for her injuries after claims against some other defendants, including Mary Kay, were resolved through mesothelioma settlements prior to trial.

The woman alleged that companies involved in supplying and manufacturing the cosmetic talc knew for years that the talc contained asbestos but failed to warn consumers.

How South Carolina Asbestos Exposure Occurs

Asbestos exposure in South Carolina is closely tied to the state's shipbuilding, textile, energy, and military history. Because asbestos was widely used, thousands of workers were exposed on the job without knowing the risks.

Exposure also occurred outside the workplace through asbestos-containing consumer products, including cosmetic talc. Our South Carolina mesothelioma lawyers can investigate where your exposure happened and pursue the compensation your family deserves.

South Carolina Military Asbestos Exposure

South Carolina veterans and civilian military workers were exposed to asbestos for decades while serving on ships, repairing equipment, maintaining buildings, and working around asbestos-containing materials.

South Carolina military sites linked to asbestos exposure include:

  • Charleston Naval Shipyard
  • Fort Jackson
  • Joint Base Charleston
  • Marine Corps Air Station Beaufort
  • Marine Corps Recruit Depot Parris Island
  • Shaw Air Force Base

If you developed mesothelioma after military service, a South Carolina armed forces mesothelioma lawyer can help identify the source of your exposure and explore your options for compensation, including VA benefits and asbestos claims.

Occupational Asbestos Exposure in South Carolina

Many South Carolina workers were exposed to asbestos while performing jobs in industries that depended on insulation, fireproofing, and other asbestos-containing materials.

South Carolina workers may have been exposed during:

  • Construction and industrial maintenance
  • Paper and chemical manufacturing
  • Power generation
  • Mining and mineral processing
  • Nuclear facility work
  • Shipbuilding and ship repair
  • Textile manufacturing

Our South Carolina asbestos exposure lawyers can investigate your work history to identify potential sources of exposure.

At-Home Asbestos Exposure in SC

Because asbestos was widely used in insulation, floor and ceiling tiles, roofing materials, pipe coverings, and other construction products, homeowners working on older South Carolina buildings may still encounter it today.

DIY remodeling, home renovations, and repair projects can release dangerous asbestos fibers when older materials are disturbed.

If your mesothelioma was caused by exposure to asbestos-containing building materials, South Carolina asbestos product lawyers at Sokolove Law can work to trace your illness back to the items that made you sick.

South Carolina Asbestos Talc Exposure

Some South Carolina residents have developed asbestos-related diseases like mesothelioma and ovarian cancer after years of using asbestos-contaminated talc products like baby powder, cosmetics, and other personal care items.

In recent years, juries have awarded $63 Million to a mesothelioma patient who used J&J baby powder daily and $29.1 Million to a woman who claimed asbestos-contaminated cosmetic talc products led to her mesothelioma.

A South Carolina talcum powder mesothelioma lawyer can handle claims involving industrial or personal talc exposure linked to a mesothelioma diagnosis.

South Carolina Secondhand Asbestos Exposure

Many South Carolina families were exposed when asbestos fibers were carried home on a loved one's clothing, shoes, hair, or work tools and released during everyday activities like doing laundry.

South Carolina courts have recognized the dangers of this take-home exposure. In one case, a jury awarded $32 Million to the family of a woman who developed mesothelioma after years of laundering asbestos-contaminated work clothes.

If you've suffered secondary asbestos exposure, you may still be able to pursue compensation. A South Carolina secondhand asbestos exposure attorney at Sokolove Law can review your case and let you know if a payout may be possible.

South Carolina Asbestos Companies & Exposure Sites

Before the dangers of asbestos were widely known, over 1,100 South Carolina job sites used asbestos-containing products in shipbuilding, textile manufacturing, power generation, mining, and more.

South Carolina Electric Gas had more than 30 asbestos exposure sites in the state — more than any other asbestos-related company. Workers may have been exposed by handling asbestos-containing wiring or equipment or by working near others who did.

Workers may have also come in contact with asbestos at:

These sites reflect historical conditions. Many facilities have since been renovated, demolished, or undergone asbestos abatement. However, our mesothelioma in South Carolina can still help pinpoint where asbestos-containing materials were once used.

Under South Carolina's asbestos regulations (S.C. Code Regs. 61-86.1), testing is generally required before any demolition or renovation project that could disturb asbestos-containing materials, particularly in commercial buildings, public facilities, and larger residential projects.

Schools must also conduct periodic asbestos inspections under the federal Asbestos Hazard Emergency Response Act (AHERA).

Who is at risk of mesothelioma in South Carolina?

Anyone exposed to asbestos can develop mesothelioma, but some South Carolina workers faced greater risk because of their occupation.

High-risk asbestos jobs in SC include:

  • Shipyard workers: Employees and Navy veterans at the Charleston Naval Shipyard and private shipyards like Detyens and Braswell Services Group worked in confined spaces with high concentrations of airborne asbestos fibers.
  • Textile workers: Upstate mill employees near Greenville and Spartanburg worked around asbestos-containing insulation, machinery, and, in some cases, asbestos textile production itself.
  • Power plant workers: Employees at nuclear and coal-fired plants encountered asbestos in boilers, turbines, and pipe insulation.
  • Vermiculite miners: Workers at vermiculite mines and processing facilities handled ore that could be naturally contaminated with asbestos.
  • Veterans: Service members at Parris Island, Shaw Air Force Base, Fort Jackson, and aboard Navy vessels may have encountered asbestos in barracks, vehicles, and shipboard insulation.

South Carolina's shipbuilding, textile, and energy history has left many workers vulnerable to asbestos-related disease decades after their exposure.

What are South Carolina asbestos regulations?

South Carolina's Department of Health and Environmental Control (DHEC) administers the state's asbestos program under S.C. Code Title 44, Chapter 87, and S.C. Code Regs. 61-86.1 (Standards of Performance for Asbestos Projects).

South Carolina asbestos laws require licensing for asbestos contractors, workers, supervisors, inspectors, and air samplers, and set procedures for inspections, abatement, air monitoring, and disposal.
