The Agency for Toxic Substances and Disease Registry reported that:

  • 516 tons of asbestos-contaminated Libby vermiculite were shipped to National Gypsum's Long Beach, California facility between 1970 and 1977.
  • Family members were likely exposed secondhand through asbestos fibers carried home on workers' clothing.
  • Residents who lived near the National Gypsum facility during the relevant time period may have also been exposed to hazardous levels of asbestos.

In addition to California, National Gypsum asbestos exposure sites were spread across nearly two dozen other states.

When the financial pressure of asbestos lawsuits got too intense, the company filed for bankruptcy and set aside hundreds of millions of dollars to compensate those harmed by their asbestos-based products.

$6 Million Mesothelioma National Gypsum Verdict

A Texas jury awarded more than $6 Million to the family of a former school janitor who died from mesothelioma at age 60 after decades of exposure to asbestos-containing joint compounds manufactured by National Gypsum and U.S. Gypsum.

The man allegedly worked for the El Paso Independent School District for 31 years and was exposed to asbestos dust during construction and renovation projects. The case involved National Gypsum's Gold Bond joint compound, which was used to finish drywall seams and contained asbestos.

Jurors found clear and convincing evidence that the janitor's death resulted from gross negligence and awarded damages to his estate, wife, children, and mother. Claims against Owens-Corning, Kelly-Moore Paint Co., and W.R. Grace Co. were settled before the trial.

$1.4 Million National Gypsum Asbestos Property Damage Verdict

Mercer University in Macon, Georgia sued National Gypsum and other manufacturers after discovering asbestos-containing materials in campus buildings. The university sought compensation for the costs of inspecting and removing asbestos products installed between 1906 and 1972.

The 11th Circuit upheld a $1.4 Million asbestos verdict against National Gypsum and W.R. Grace, finding that the presence of asbestos-containing materials could support property damage claims even before fibers caused widespread contamination.

In addition to causing illnesses such as mesothelioma and lung cancer among workers, asbestos-containing construction products also created substantial financial burdens for schools, universities, and other building owners forced to address asbestos hazards decades later.

$8.4 Million National Gypsum Asbestos Settlement to Schools

National Gypsum agreed to pay $8.4 Million to school districts in 19 states to resolve claims involving asbestos-containing materials installed in schools across the country.

National Gypsum asbestos-containing products like joint compounds, insulation materials, and fireproofing were commonly used in school construction for decades before the health risks became widely known.

The asbestos settlement was meant to compensate school districts for the expensive removal and remediation of asbestos in their buildings.

Landmark Court Ruling Helped Victims Pursue National Gypsum Asbestos Claims

In Roehling v. National Gypsum Co. Gold Bond Building Products, the 4th Circuit ruled that asbestos exposure victims could rely on circumstantial evidence to prove exposure to a company's products.

The lawsuit was brought by the widow of a New York pipefitter who developed mesothelioma after working at:

  • Huntley Power Station from July 1948 to December 1948
  • DuPont Cellophane Plant from December 1948 to April 1949
  • Ford Stamping Plant from July 1950 through March 1951

Although the worker could not personally identify every asbestos product he encountered, co-workers testified that National Gypsum's Gold Bond asbestos cement, blankets, and insulation products were heavily used at the same locations where he worked.

The court found this evidence was sufficient to allow the claims against National Gypsum and other manufacturers to proceed. The decision recognized that workers cannot always recall specific product names decades after their exposure occurred.

National Gypsum Mesothelioma Settlement for Wrongful Death

National Gypsum was among several asbestos-related companies named in a mesothelioma wrongful death lawsuit filed by the family of a former Brooklyn Navy Yard electrician who died from the cancer after being exposed to asbestos during World War II-era shipbuilding work.

The veteran's widow alleged that asbestos-containing products manufactured by National Gypsum and other companies were used throughout the Navy Yard while her husband worked there between 1944 and 1945.

Before trial, a mesothelioma settlement was reached with National Gypsum and most of the other defendants in the case.
