What Is a Mesothelioma Verdict vs. Settlement?

Mesothelioma lawsuits give patients and their families a way to pursue justice, hold asbestos-related companies accountable, and recover financial compensation. These lawsuits may be resolved through a mesothelioma verdict or settlement.

Many companies hid the truth about the health risks tied to their products, which is why they can be sued. While every case is different, asbestos lawsuits have resulted in substantial payouts that send a powerful message about corporate wrongdoing.

Mesothelioma Trial Verdicts vs. Settlements

  • Mesothelioma Settlements: The mesothelioma victim's attorney and the asbestos-related companies that caused harm negotiate a set amount of money to resolve the case, often without going to court.
  • Mesothelioma Trial Verdicts: If a settlement cannot be reached, the case may go to court, where a judge or jury will hear the evidence and determine the outcome through a verdict.

At Sokolove Law, over 99% of our mesothelioma lawsuits result in settlements, allowing most clients to receive compensation faster — and without ever having to set foot in court.

However, we prepare every case as if it will go to trial, so we’re ready for the fight. Our mesothelioma trial attorneys have successfully secured significant asbestos verdicts for families nationwide.

Average Mesothelioma Lawsuit Verdict Amounts

Mesothelioma lawsuit verdicts often result in higher payouts than settlements. Juries may award damages based on the full impact of asbestos exposure, as well as punitive damages meant to punish and deter future wrongdoing.

On average, mesothelioma settlements range from $1 Million to $1.4 Million, while mesothelioma trial verdicts range from $5 Million to $11.4 Million.

The average mesothelioma settlement ($1M-$1.4M) and trial verdict amount ($5M-$11.4M)

Compensation from a mesothelioma verdict or settlement can help with medical bills, lost income, and expenses not covered by insurance, while also holding asbestos-related companies accountable.

Our Mesothelioma Verdict Amounts

Mesothelioma verdicts can result in life-changing compensation, providing financial relief and peace of mind as families are faced with a cancer diagnosis.

While the majority of mesothelioma claims result in settlements, some cases proceed to trial and result in verdicts. When companies refuse to offer full compensation for a victim's losses, pursuing a verdict may help victims recover the financial support they deserve.

A few of our mesothelioma verdicts include:

  • $40 Million to a veteran exposed through gaskets on naval ships
  • $34 Million for a refinery worker who suffered on-the-job asbestos exposure
  • $8.26 Million to a mechanic who handled asbestos-containing brakes and clutches
  • $5.11 Million for the family of a woman who suffered secondhand exposure
  • $6.8 Million to a Pennsylvania welder who worked with asbestos-containing valves
  • $2.86 Million for the family of a factory worker exposed to industrial talc

While there's never a guarantee of compensation in any case, our mesothelioma trial attorneys will fight hard for everything you're entitled to.

These mesothelioma verdicts show how asbestos exposure in workplaces, military service, and even through secondhand contact can lead to serious illness.

$40 Million U.S. Navy Mesothelioma Verdict

A New York jury awarded $40.1 Million to U.S. Navy veteran Walter Twidwell after finding Goodyear responsible for exposing him to asbestos. Walter developed pleural mesothelioma decades after working with Durabla and Cranite gaskets that released asbestos fibers when handled.

Walter enlisted in the U.S. Navy at 17 years old and served for nearly 20 years, including during the Korean and Vietnam Wars. As a boiler tender and fireman, he worked in engine and fire rooms, maintaining pumps, valves, and other equipment.

Walter's duties required him to manipulate asbestos-containing gaskets and packing materials manufactured by Goodyear. Although Walter knew the materials contained asbestos, he was never warned that exposure could cause cancer.

Evidence presented at trial showed that Goodyear had known about the dangers of asbestos as early as 1939 but failed to warn service members. Walter testified about the anger he felt upon learning the truth.

“When I got told they knew many years prior what asbestos would do to the human being, I got mad. Heck with this noise. They’re gonna hear from me.”
– Walter, U.S. Navy Veteran & Sokolove Law Client

During a 2-week mesothelioma trial, our attorneys highlighted how the disease took away Walter’s independence. Once able to build his own log cabin and maintain his property, he later struggled with severe breathing problems and fatigue.

After hearing the evidence, the jury deliberated for less than 2 hours before returning a $40 Million U.S. Navy mesothelioma verdict in Walter’s favor.

$34 Million Illinois Mesothelioma Verdict

A jury awarded $34.1 Million to a roofing worker after finding that Shell Oil Co. exposed him to asbestos during his time as a contractor at their Wood River refinery in Illinois.

The roofer reportedly performed repair and installation work at the facility between 1956 and 1966 and was exposed to asbestos-containing insulation dust released during refinery shutdowns and equipment maintenance. Decades later, he developed mesothelioma.

At trial, medical experts testified about the devastating impact of the disease, which required him to undergo extensive surgeries, including the removal of a lung and parts of the lining around his lungs and heart. One physician described the pain caused by mesothelioma as “off the scale.”

Evidence presented by our attorneys showed that Shell had known about asbestos hazards as early as 1945 but failed to warn workers. Testimony also revealed that key evidence had been withheld by the company, including over 100 boxes of internal records related to asbestos hazards.

After a 2-week trial, the jury deliberated for approximately 5 hours before returning the mesothelioma verdict, which included $25 Million in punitive damages to punish the company for their actions.

$8.26 Million Louisiana Mesothelioma Verdict

A Louisiana jury awarded $8.26 Million to mechanic Steven “Joe” Aaron Sr. after finding that Ford Motor Company failed to adequately warn him about the dangers of asbestos exposure from their vehicle parts.

At age 65, Joe was diagnosed with mesothelioma after working as a gas station and school bus mechanic in the 1960s and 1970s. He had regularly serviced Ford vehicles with asbestos-containing brakes and clutches.

Each repair released asbestos dust into the air, which Joe inhaled over many years. Our team presented evidence at trial showing that Ford knew or should have known about the dangers of asbestos but failed to provide sufficient warnings or protection.

Before his diagnosis, Joe lived an active life and spent time with his grandchildren, often helping them with outdoor activities and daily tasks. As his illness progressed, he became physically unable to maintain the same level of independence.

After a 3-week trial, the jury deliberated for approximately 1 hour before returning the Louisiana mesothelioma verdict, highlighting the strong evidence linking Joe's cancer to Ford's auto parts.

$5.11 Million Secondhand Asbestos Verdict

A Missouri jury awarded $5.1 Million to the family of Stephanie Foster, a 42-year-old woman who died of mesothelioma after experiencing secondhand asbestos exposure as a child.

Stephanie's exposure occurred when her father unknowingly brought asbestos dust home on his clothing after working with asbestos-containing rocket components at Aerojet in the 1960s.

Like many victims of secondhand exposure, Stephanie had no direct occupational contact with asbestos and didn’t know she had been exposed until decades later, when she was diagnosed with mesothelioma.

At the wrongful death mesothelioma trial, our attorneys presented evidence showing that the aerospace company had used large quantities of asbestos and was aware of its dangers. As a result of misleading claims about asbestos use, the judge limited the company’s defense at trial.

After a 2-week trial, the jury returned a secondhand asbestos verdict in favor of Stephanie’s family. The mesothelioma verdict reinforced that companies may be held accountable for exposing workers as well as for putting their families in harm's way.

$6.8 Million New York Mesothelioma Verdict

A New York jury awarded welder Thomas McGlynn a $4.6 Million mesothelioma verdict after finding that exposure to asbestos-containing valves caused him to develop cancer.

Thomas was exposed to asbestos while building and repairing boiler rooms on ships in the New York City area during the 1970s and 80s. He worked with valves made by Jenkins Bros. that contained asbestos gaskets, packing, and insulation.

Expert testimony at trial linked his illness directly to asbestos fibers from the valves he worked with throughout his career. Evidence also showed that Jenkins Bros. knew about the dangers of asbestos but failed to warn workers or provide adequate safety protections.

After the initial New York mesothelioma verdict, a judge took the rare step of increasing the award to $6.8 Million through a legal process known as additur, recognizing that the original compensation did not fully reflect Thomas' suffering.

$2.86 Million Delaware Talc Mesothelioma Verdict

A Delaware jury awarded $2.86 Million to the family of Michael Galliher, a factory worker who passed away just months after his pleural mesothelioma diagnosis at the age of 62 after decades of exposure to asbestos-contaminated talc.

The jury found mining company RT Vanderbilt 100% liable for supplying asbestos-contaminated talc, which Michael used regularly during his nearly 40-year career at Crane Plumbing Fixtures Factory.

Michael used the talc to dust molds for sinks, bathtubs, and other ceramic fixtures, a process that released asbestos fibers into the air. These fibers came from talc mined and supplied by RT Vanderbilt, but the company failed to provide proper warnings.

“This outcome is not about the money. This is about the fact that a jury has held RT Vanderbilt responsible for its actions. We just hope no other family has to go through the pain and loss we have experienced.”
– Darcel, Michael's Wife

A key breakthrough in the case came when experts identified the unique “fingerprint” of the company’s talc in Michael's lung tissue, directly linking the company to his illness.

The Delaware talc mesothelioma verdict marked the largest asbestos verdict against a single defendant in the state in more than a decade and reinforced that companies may be held fully responsible when their products cause harm.

While there's never a guarantee of success in any case, our mesothelioma trial lawyers fight for the highest amount of compensation possible for our clients.

Negotiating a Settlement

Settlements often allow families to receive compensation faster and without going to trial. There’s an average of 64 defendants named in each mesothelioma lawsuit, according to KCIC. Your attorney will work to negotiate a settlement with each one.

We’ve secured significant mesothelioma compensation from settlements:

  • $11.49 Million to a demolition worker exposed to asbestos in Florida
  • $9.6 Million for a California construction worker diagnosed with mesothelioma
  • $7 Million for a welder with malignant mesothelioma
  • $6.5 Million to a U.S. Army veteran and oil field worker in Louisiana
  • $11.26 Million awarded to a mesothelioma patient in Arizona

While the majority of defendants settle, our firm is prepared to take your case to court and seek compensation from a trial verdict for those who don’t.

Getting Asbestos Verdicts in Court

Despite the likelihood of a settlement, we prepare every case as if it will go to trial, so your legal team is fully prepared to present your case before a judge and jury.

Asbestos verdicts can hold companies fully accountable and may result in substantial financial awards for victims and their family members.

  • Working with Medical and Occupational Experts: Our attorneys have close relationships with expert witnesses who can help prove that asbestos exposure caused your diagnosis and explain the long-term impact of the disease.

  • Building a Compelling Trial Strategy: Our mesothelioma trial attorneys will prepare testimony, evidence, and legal arguments designed to clearly show liability and damages to a jury.
  • Presenting Your Case in Court: During an asbestos trial, your team will question witnesses, present expert testimony, and explain how asbestos exposure affected your health, finances, and quality of life.

What to Expect with a Mesothelioma & Asbestos Trial

If your mesothelioma case proceeds to trial, your legal team will guide you through every step of the process. While mesothelioma trials are much less common than settlements, we’ll work to make the process as easy and stress-free as possible.

In many cases, much of the work involved in an asbestos trial can be done without requiring patients or their loved ones to appear in court.

Here are some key parts of the mesothelioma trial process:

  • Deposition: A deposition is sworn testimony you give before trial, usually in a comfortable setting like your home or your lawyer’s office. You’ll answer questions about your work history, asbestos exposure, and how mesothelioma has affected your life. Our attorneys will prepare you in advance and be present to support you throughout the process.
  • Pretrial Preparation: We’ll gather evidence, consult experts, and come up with a legal strategy. Throughout this time, our lawyers will handle all of the legal legwork on your behalf.
  • Court Appearances: In many cases, mesothelioma patients do not need to attend the full trial. Your deposition is often used as your primary testimony, especially if attending court would be difficult due to your health.
  • Trial Proceedings: During the asbestos trial, lawyers present evidence, question witnesses, and explain how asbestos exposure caused your illness. Trials may last from several days to a few weeks, depending on the complexity of the case.
  • Jury Deliberation and Verdict: After hearing the evidence, the jury deliberates and decides whether the asbestos-related company is liable and how much compensation should be awarded.

Our mesothelioma trial attorneys are committed to minimizing any disruptions in your life, so you can continue to focus on treatments and family while we handle the courtroom process.

"Preparing my dad for the deposition was quite the experience. We spent hours on the phone, and they made my dad feel so comfortable. They were on the same team, that's how it felt. And they took my dad and pretty much held his hand and walked him through the whole thing."

U.S. Navy Mesothelioma Verdicts

U.S. Navy veterans account for a large percentage of mesothelioma diagnoses, with approximately 33% of all mesothelioma patients having served in the military. These veterans are especially at risk due to the widespread use of asbestos in ships and shipyards for much of the 20th century.

Decades later, thousands of U.S. Navy veterans have been diagnosed with mesothelioma as a result of this exposure. U.S. Navy mesothelioma verdicts have helped hold asbestos-related companies accountable and provided compensation to veterans and their families.

Find out more about past U.S. Navy mesothelioma verdicts:

  • $11.2 Million: A Washington asbestos verdict awarded $11.2 Million to a worker who developed mesothelioma linked to his disassembly of U.S. Navy ships that were active during World War II.
  • $2.5 Million: A California mesothelioma verdict awarded $2.5 Million to a former U.S. Navy Admiral who attributed his illness to asbestos-containing insulation he came in contact with during his service.
  • $40.1 Million: A New York asbestos verdict awarded $40.1 Million to a U.S. Navy veteran in Washington state who developed mesothelioma linked to Goodyear gaskets that he maintained and repaired while serving as a boiler tender and fireman.
  • $17 Million: An Arizona mesothelioma lawsuit verdict awarded $17 Million to the family of a civilian U.S. Navy worker who repaired and maintained equipment on ships at Norfolk Naval Shipyard in Virginia from 1959 to 1966.
  • $71 Million: A California mesothelioma verdict awarded $71 Million to a U.S. Navy veteran and nuclear inspector who was harmed by asbestos-containing packing and gaskets manufactured by John Crane.

U.S. Navy mesothelioma verdicts reflect the serious risks veterans faced due to widespread asbestos use aboard ships and in shipyards. Many service members were exposed while performing routine duties without being warned about the long-term health dangers.

At Sokolove Law, we don't sue the government or U.S. military for mesothelioma. Instead, our lawsuits are filed against the asbestos-related companies who manufactured and supplied the products that put millions of service members in harm's way.

Pursuing compensation from an asbestos verdict doesn't impact a veteran's ability to collect VA benefits, so there's no risk to taking legal action.

In February 2026, a California appeals court upheld a $51 Million mesothelioma verdict against Avon® Products Inc. and another defendant after a jury found that asbestos-contaminated talc in the company’s cosmetics caused a woman to develop malignant mesothelioma.

The original verdict was awarded in Los Angeles Superior Court, and her husband continued the case after her death, seeking accountability for the harm caused by Avon’s talc products.

At the mesothelioma trial, jurors determined that Avon’s defective product design and failure to warn consumers were major factors in causing the woman's illness.

In January 2026, a Louisiana court entered a $12.5 Million mesothelioma verdict against Goodyear Tire and Rubber Co. after finding the company responsible for exposing an office manager to asbestos through their brake products.

In December 2025, a Maryland jury awarded $1.5 Billion to Cherie Craft, who developed peritoneal mesothelioma after decades of using Johnson & Johnson’s talc-based baby powder. She claimed that the company’s products contained asbestos and led to her cancer diagnosis.

Craft reportedly used the company's talc products on herself and her children for more than 40 years, beginning in 1971. The Johnson & Johnson baby powder mesothelioma verdict consisted mostly of punitive damages meant to punish J&J.

Evidence presented at trial showed that J&J failed to adequately warn consumers about the potential presence of asbestos in their products. The award is the largest single-plaintiff talc mesothelioma verdict to date.

$65.5 Million Minnesota Mesothelioma Lawsuit Verdict for Talc Victim

In December 2025, a Minnesota jury awarded a $65.5 Million mesothelioma lawsuit verdict to a 37-year-old mother who developed pleural mesothelioma after years of using Johnson & Johnson’s baby powder.

During a 13-day mesothelioma trial in Ramsey County District Court, the victim's legal team claimed J&J sold talc-based products to consumers despite knowing they could be contaminated with asbestos.

To help prove the case, the family's mesothelioma trial attorneys presented internal company documents and expert testimony showing that J&J misinterpreted or minimized asbestos test results and failed to fully disclose safety risks.

The jury awarded $16 Million in compensation for her medical bills, suffering, and eventual death, along with $950 Million in punitive damages meant to penalize J&J for serious wrongdoing and deter similar conduct in the future.

Mesothelioma & Asbestos Verdict FAQs

What is a mesothelioma verdict?

A mesothelioma verdict is a ruling and amount of compensation awarded by a judge or jury in an asbestos trial that determines if the company is legally responsible for causing mesothelioma. If the company is found liable, the court may award financial compensation to the victim.

Mesothelioma verdicts, which are public, may be worth more than a settlement. However, they carry the risk of appeal, and families may need to wait longer to receive compensation.

Get a free case review now to see if you may be eligible for compensation.

What is the average payout for mesothelioma victims?

Mesothelioma payouts can vary depending on the details of the case, but compensation typically ranges from $1 Million to $11.4 Million on average, depending on whether the case resolves through a settlement or a trial verdict.

The average mesothelioma settlement is between $1 Million and $1.4 Million, which typically provides compensation without going to trial. Mesothelioma verdicts are often higher, with average jury awards ranging from $5 Million to $11.4 Million.

Our experienced mesothelioma trial attorney can evaluate your case and help you understand what compensation may be available. Call (800) 647-3434 to get started.

What was the latest mesothelioma verdict in 2026?

One of the latest mesothelioma verdicts involved a $1.5 Billion award issued by a Maryland jury against Johnson & Johnson. The jury found that the company’s talc-based baby powder exposed a woman to asbestos, causing her to develop peritoneal mesothelioma.

This landmark mesothelioma verdict is the largest ever awarded to a single plaintiff in talc litigation. It reflects a growing trend of juries holding companies accountable when evidence shows that asbestos exposure from consumer products caused harm.

What was the verdict on the asbestos case?

In October 2025, a California jury awarded a $966 Million asbestos verdict to the family of a woman who died from mesothelioma after decades of using Johnson & Johnson’s talc-based baby powder. The wrongful death lawsuit alleged that asbestos-contaminated talc in the company’s products caused her cancer.

The verdict included $16 Million in compensatory damages for the victim's illness and death, as well as $950 Million in punitive damages intended to hold J&J accountable for failing to warn consumers about asbestos risks linked to their talcum powder products.

What do mesothelioma trial lawyers do?

Mesothelioma trial lawyers represent patients and families seeking compensation from companies responsible for asbestos exposure. They investigate your exposure history, identify the companies responsible, and build a strong case to pursue compensation through settlements or trial verdicts.

Mesothelioma trial lawyers handle every step of the legal process, including:

  • Investigating Asbestos Exposure: Reviewing your work history, military service, and product exposure to determine where and how exposure occurred
  • Gathering Evidence: Collecting medical records, employment documents, and expert testimony to prove that asbestos caused your mesothelioma
  • Filing Legal Claims: Preparing and submitting lawsuits and other compensation claims within required deadlines
  • Negotiating Settlements: Working with asbestos-related companies to pursue fair compensation without the need for a trial whenever possible
  • Representing You in Court If Necessary: Presenting your case before a judge and jury when companies refuse to offer full compensation

Our experienced mesothelioma trial lawyers prepare every case for trial, even though the majority of claims settle out of court. This approach helps strengthen your claim and ensures your legal team is ready to pursue the maximum compensation available.

Do you have to pay taxes on a mesothelioma verdict?

In most cases, compensation from a mesothelioma settlement or verdict is mostly not taxable under federal law. The IRS generally does not tax compensation awarded for personal physical injuries or illnesses. However, there are some exceptions.

Certain portions of a mesothelioma verdict may be taxable, including:

  • Punitive damages, which are intended to punish the company rather than compensate the victim
  • Interest on the award, which may accrue while a case is pending or after a verdict
  • Previously deducted medical expenses, if you claimed those expenses on your taxes and later received reimbursement

Tax laws can be complex, and each case is different. It’s important to speak with a qualified tax professional to understand how your specific mesothelioma verdict or settlement may be treated for tax purposes.

How long does it take to settle a mesothelioma lawsuit?

Many of our clients start receiving compensation from a mesothelioma settlement within 90 days, with additional payouts coming in over the next 12-18 months.

The payout timeline can vary based on several factors, including:

  • Court schedules and legal procedures
  • The number of companies involved in the lawsuit
  • The strength of the evidence linking asbestos exposure to your diagnosis
  • Whether defendants agree to settle or contest the claim

Mesothelioma trial lawyers work to move cases forward as quickly as possible, especially because the disease is aggressive. While most cases settle before trial, having experienced trial lawyers ensures your case is prepared for any outcome.

What is a typical mesothelioma settlement?

A typical mesothelioma settlement ranges from $1 Million to $1.4 Million, although the exact amount depends on the details of each case.

Mesothelioma settlements typically allow victims and their families to receive compensation without going to trial. This compensation may help cover medical expenses, lost income, pain and suffering, and other costs related to the disease.

How can I find a mesothelioma trial attorney near me?

Finding the right mesothelioma trial attorney starts with looking for a lawyer who has experience handling asbestos cases and taking claims to trial when necessary.

Working with a national mesothelioma law firm like Sokolove Law gives you access to mesothelioma trial attorneys who have a long history of securing results and the resources to investigate your exposure, build a strong case, and pursue compensation through a settlement or verdict.

How much does a mesothelioma trial attorney cost?

At Sokolove Law, there are no upfront costs or hourly fees to work with our mesothelioma trial attorneys. We operate on a contingency-fee basis, which means you pay nothing unless we secure compensation for you.

With this arrangement, legal fees are taken as a percentage of the compensation recovered, whether that be a mesothelioma verdict or settlement. If no compensation is recovered, you owe nothing.
