Ohio Mesothelioma Statute of Limitations

The statute of limitations sets a deadline for filing a mesothelioma lawsuit. Like other states, Ohio restricts how long victims and their families have to take legal action after an asbestos-related diagnosis or death.

The Ohio mesothelioma statute of limitations generally gives patients 2 years from the date of their diagnosis to file a personal injury lawsuit (Ohio Revised Code § 2305.10(B)(5)). Families typically have 2 years from the date of death to file a wrongful death claim (Ohio Revised Code § 2125.02(D)).

Taking action as soon as possible can make it easier to gather employment records, identify witnesses, and document asbestos exposure. Waiting too long could prevent you from filing a claim and recovering compensation.

Call (800) 647-3434 right now to see if you may qualify for an Ohio mesothelioma lawsuit. It costs nothing to speak with us.

Mesothelioma in Ohio Lawsuit Updates & News

Ohio families continue to pursue mesothelioma claims against companies that manufactured, sold, or used asbestos-containing products. These lawsuits stem from exposure in a variety of settings, including those linked to the state's industrial past.

For decades, Ohio courts have handled asbestos cases brought by workers, veterans, and surviving family members. Many of these claims have ended in settlements, helping families recover compensation for medical expenses, lost income, and other losses.

Here are some of the latest Ohio asbestos and mesothelioma lawsuit updates:

  • September 2025: An Ohio elementary school was closed after environmental testing detected an elevated level of asbestos in one classroom. Solon City Schools officials hired an independent third-party lab to help determine when students and staff can safely return.
  • December 2024: Ohio lawmakers approved legislation adding new requirements for asbestos lawsuits, requiring victims to identify specific asbestos-containing products, exposure sites, and witnesses early in the litigation process.
  • June 2024: The U.S. Environmental Protection Agency (EPA) issued a notice of violation to ACCEL Schools Ohio over asbestos and lead paint concerns at three charter schools in Youngstown, Niles, and Warren. Federal and state inspectors found that the schools lacked required asbestos management plans.
  • May 2024: An Ohio magistrate recommended a $19.84 Million civil penalty against Sawyer Towers apartment complex in Columbus for violating Ohio asbestos regulations. The complex allegedly ignored asbestos abatement plans, failed to warn contractors about potential exposure, and allowed asbestos fibers to spread throughout the 400-unit complex.
  • June 2021: The estate of an 83-year-old mesothelioma victim was awarded more than $12 Million after an Ohio jury found that he developed the disease from years of working with asbestos-containing packing materials.
  • April 2016: An Ohio probate court sought heirs to hundreds of deceased rubber workers who developed asbestos-related diseases as part of an effort to distribute approximately $2 Million in unpaid asbestos claims. The payments stemmed from an $80 Million settlement with insurers over asbestos exposure claims.
  • July 2015: A Toledo developer was sentenced for illegally removing and disposing of asbestos during the demolition of the former Champion Spark Plug facility. Prosecutors said unlicensed workers removed friable asbestos pipe insulation and dumped the material at multiple locations in Lucas County, resulting in jail time, community service, and more than $25,000 in cleanup and investigative costs.
  • September 2014: The Ohio Supreme Court ruled that smokers alleging asbestos exposure caused their lung cancer must provide a diagnosis from a "competent medical authority" showing that asbestos was a substantial contributing factor to the disease.
  • January 2014: A Cleveland jury awarded an English professor and his wife $27.5 Million after finding that his mesothelioma was caused by secondhand asbestos dust his father unknowingly carried home on his work clothes, making it one of the largest asbestos verdicts in Ohio history.
  • July 2011: An Ohio construction company owner was sentenced for violating federal asbestos regulations during renovations at the former Weirton Steel Plant in Steubenville. Prosecutors said the company failed to properly handle thousands of feet of asbestos-containing pipe insulation, resulting in probation, fines, and an order to provide baseline X-rays for employees involved.

Recent events across Ohio demonstrate that asbestos remains an ongoing public health concern, affecting workers, residents, students, and communities in a variety of settings.

These incidents underscore that the dangers of asbestos have not disappeared. Aging infrastructure, renovation projects, demolitions, and occupational exposures can still release hazardous fibers and put everyday people at risk.

$27.5 Million Ohio Take-Home Asbestos Verdict

A Cuyahoga County jury awarded more than $27.5 Million to an English teacher who allegedly developed mesothelioma from secondhand asbestos exposure as a child. Included in the verdict was $15 Million to the man's wife for loss of services.

The victim's father worked for decades at Eaton Airflex, a brake pad manufacturer, and regularly came home with asbestos dust on his clothing, exposing his family to the fibers, according to the lawsuit. The father reportedly died of lung cancer at age 52.

Jurors found brake products manufacturer Kelsey-Hayes 60% responsible. The mesothelioma verdict was believed to be the largest asbestos award in Ohio at the time.

$12 Million Ohio Packaging Asbestos Exposure Verdict

A Lorain County jury awarded more than $12 Million to the estate of a Korean War veteran who died from mesothelioma at age 83 after decades of occupational asbestos exposure.

The verdict included an initial $6.1 Million award, with the trial judge later adding another $6 Million in punitive damages against product manufacturer John Crane Inc.

The veteran worked for more than 40 years at the Pfaudler Company plant in Elyria, where he regularly cut asbestos-containing rope packing used in industrial equipment. According to trial evidence, the packing material contained blue crocidolite asbestos, one of the most dangerous forms of the mineral.

$4.5 Million Ohio Mesothelioma Lawsuit Verdict

The family of an Ohio mechanic who died at age 51 from malignant mesothelioma received a $4.5 Million asbestos verdict. He was allegedly diagnosed with mesothelioma in 1997 and died less than 2 years later.

A Cuyahoga County judge found Nationwide Brake and Alignment Centers liable for exposing the worker to asbestos dust over many years.

The man reportedly worked at Marzec Motors in Cleveland from 1964 to 1978 and interacted with mechanics employed by Nationwide Brake and Alignment, which operated in the same building. The lawsuit alleged that he was exposed to asbestos fibers released during brake repairs.

$80 Million Ohio Asbestos Settlement for Rubber Workers

An Ohio probate court spent years trying to locate the heirs of hundreds of former rubber workers who died or became seriously ill from asbestos-related diseases so they could receive compensation from an $80 Million asbestos settlement.

Approximately $2 Million in claims remained unpaid because many of the workers had died long before the litigation was resolved and their surviving family members could not be located.

The settlement fund was created after insurers agreed to resolve thousands of asbestos claims brought by current and former rubber workers. However, years of appeals delayed the payouts until a federal appeals court ordered the settlement money to be distributed.

According to reports, roughly 19,000 asbestos claims nationwide were eligible for payment, with Summit County accounting for nearly 6,000 of those cases. Individual compensation awards ranged from approximately $2,100 to $23,000, depending on the worker's diagnosis and the severity of their illness.

Asbestos lawsuits, regulatory actions, and exposure incidents show that asbestos remains an ongoing issue throughout Ohio. If your family is facing a mesothelioma diagnosis, our Ohio asbestos attorneys are here to hold responsible companies accountable.

Our asbestos lawyers in Ohio help families pursue compensation for many different types of asbestos-related claims. The type of claim you may be eligible to file often depends on your diagnosis, how the exposure occurred, and which companies may be responsible.

Our Ohio asbestos attorneys represent clients in cases involving mesothelioma, asbestos-related lung cancer, secondary or take-home exposure, talcum powder lawsuits, and other asbestos-related diseases and injuries.

Mesothelioma Attorney in Ohio

Mesothelioma is a rare and aggressive cancer that develops after exposure to asbestos. Our mesothelioma attorneys in Ohio can investigate your employment history, military service, and other potential sources of exposure to identify the companies responsible for your illness.

About 110 new mesothelioma cases are diagnosed in Ohio per year, according to the Ohio Department of Health.

We work to pursue compensation from every available source, including mesothelioma lawsuits, asbestos trust funds, and VA benefits, helping families recover money for medical treatment, lost income, and other expenses related to the disease.

Ohio Mesothelioma Wrongful Death Lawyer

If a loved one passed away from mesothelioma or another asbestos-related disease before filing a claim or before their case was resolved, surviving family members may still be able to pursue compensation with the help of our Ohio mesothelioma wrongful death attorneys.

More than 12,697 Ohio residents have died from asbestos-related diseases, as reported by the Environmental Working Group (EWG). Ohio recorded 996 deaths linked to asbestosis from 1999 to 2017.

A wrongful death claim can help surviving loved ones seek compensation for funeral and burial costs, lost financial support, loss of companionship, and other damages resulting from an asbestos-related death.

Ohio Lung Cancer Attorney

Asbestos exposure is a known cause of lung cancer, particularly among workers who inhaled asbestos fibers over many years in industrial, construction, and manufacturing settings.

In Ohio, the rate of new lung cancer cases is significantly higher than the national average, with 63.9 cases per 100,000 people compared to 52.8 cases per 100,000 people nationwide, as reported by the American Lung Association.

Our Ohio lung cancer lawyers help victims determine if exposure may have contributed to their diagnosis and seek compensation from the companies that put them at risk.

Ohio Talcum Powder Lawyers

Studies and testing have found microscopic asbestos fibers in certain talcum powder products, raising concerns about a link between contaminated talc and serious illnesses like mesothelioma and ovarian cancer.

Because talc and asbestos often form near one another underground, talc deposits can become contaminated with asbestos during mining and processing.

Our Ohio talcum powder lawyers can help individuals and families pursue claims against manufacturers that sold asbestos-contaminated talc products without adequately warning about the potential health risks.

Ohio Secondary Asbestos Exposure Lawyers

Secondary asbestos exposure occurs when workers unknowingly bring asbestos fibers home on their clothing, shoes, hair, or tools. Family members can then be exposed through everyday activities like doing laundry, cleaning work clothes, or even hugging a loved one after work.

In one case, a Cuyahoga County jury awarded $27.5 Million to an Ohio professor who developed mesothelioma after being exposed to asbestos dust his father carried home on his work clothes. The case remains one of the largest asbestos verdicts in Ohio history.

Our Ohio secondary asbestos exposure lawyers help spouses, children, and other family members pursue compensation if they developed mesothelioma or another asbestos-related disease after being exposed to asbestos brought home by someone else.

Early symptoms of mesothelioma may include:

  • Abdominal pain or swelling
  • Chest pain or tightness
  • Fatigue and weakness
  • Fluid buildup around the lungs or abdomen
  • Persistent cough
  • Shortness of breath
  • Unexplained weight loss

As the disease progresses, symptoms often become more severe and can significantly affect a person's ability to work, perform daily activities, and maintain their quality of life.

What does Ohio mesothelioma treatment involve?

Mesothelioma treatment often involves a combination of therapies, including surgery, chemotherapy, immunotherapy, and radiation therapy. The treatment approach that's right for you will depend on the type of mesothelioma, stage of the disease, and your treatment goals.

An Ohio mesothelioma cancer center can develop a treatment plan designed to slow the progression of the disease, relieve symptoms, and improve quality of life.

Can you remove asbestos yourself in Ohio?

In certain situations, Ohio homeowners may legally remove asbestos from their own single-family residence. However, disturbing asbestos-containing materials can release dangerous fibers into the air and create serious health risks for anyone nearby.

Ohio has strict rules governing many types of asbestos abatement work, particularly in commercial buildings, public facilities, and larger renovation or demolition projects. Depending on the circumstances, state and federal notification, handling, and disposal requirements may also apply.

Before beginning any project that could involve asbestos, homeowners should review Ohio asbestos regulations and consider consulting a licensed asbestos professional to inspect the material and evaluate the safest course of action.

Who is at risk of mesothelioma in Ohio?

Anyone who has been exposed to asbestos can develop mesothelioma, but some workers face a greater risk because their jobs involved frequent contact with asbestos-containing materials and products.

Workers may have been exposed through:

  • Ohio machinery asbestos exposure: Workers who manufactured, repaired, or maintained industrial machinery may have been exposed to asbestos in gaskets, pumps, boilers, turbines, and other equipment components.
  • Ohio paper products asbestos exposure: Employees at paper mills and paper manufacturing facilities often worked around asbestos-containing insulation, piping systems, and industrial equipment used in high-heat operations.
  • Ohio power plant asbestos exposure: Power plant workers frequently encountered asbestos in boilers, steam pipes, turbines, and electrical equipment because the mineral was widely used for heat resistance and fireproofing.
  • Ohio railroad asbestos exposure: About 100 asbestos exposure sites in Ohio have been linked to railroad companies, including 14 associated with the Baltimore & Ohio Railroad Co. An Ohio railroad mesothelioma lawyer can link railroad work to a diagnosis.
  • Ohio military asbestos exposure: Veterans and civilian employees may have been exposed to asbestos while serving on ships, maintaining vehicles and aircraft, or working in military buildings constructed during the peak years of asbestos use.

Ohio's long history of manufacturing, power generation, and heavy industry has left many workers vulnerable to asbestos-related diseases.

In addition, the state is home to several military installations that were built or expanded during the peak years of asbestos use, potentially exposing service members, civilian employees, and contractors to asbestos-containing materials.
