An Oregon federal judge ruled that Unum unfairly denied a product manager's long-term disability claim despite evidence that anxiety, depression, and post-traumatic stress disorder kept her from doing her high-stress job.

The court was presented with evidence from the woman's treating providers that she could not return to work, and her employer agreed she was no longer able to function in the industry.

However, Unum relied on a flawed paper review and disregarded evidence supporting disability, meaning that they failed to fairly evaluate whether the policyholder could perform the duties of her occupation.

The judge concluded that Unum abused their discretion and should not get a second chance to fix the review. Instead of sending the claim back, the court ordered an award of benefits in the plaintiff's favor.

Unum Denied Oregon Attorney a Full and Fair Review

An Oregon federal judge ruled that Unum violated ERISA law by changing the basis for denying an attorney’s LTD claim during the appeal process.

Unum first determined that the policyholder was not disabled through the policy’s 180-day elimination period. However, on appeal, they concluded that she was disabled for a period of time but subsequently improved enough to return to work.

The court ruled that this shift deprived the attorney of a fair chance to respond to the new reason for denial. In other words, Unum did not give her the full and fair review ERISA requires before cutting off her claim for benefits after that date.

A federal judge ordered that a disability benefits lawsuit against Unum be moved from Arizona to Oregon because the policyholder's employment, injury, medical treatment, and insurance claims occurred there.

The case involved a registered nurse at PeaceHealth in Oregon who alleged that Unum had wrongfully denied his long-term disability benefits following a fight with a coworker that left him unable to work.

In transferring the case, the court noted that the nurse was an Oregon resident during the relevant period, even though he previously lived with his ex-wife in Arizona.
