A West Virginia federal judge ruled that a policyholder can move forward with a lawsuit alleging that the Paul Revere Life Insurance Company and Unum Group acted in bad faith when terminating her LTD benefits.

The insurers attempted to move the case to federal court on the grounds that the claims were governed by ERISA law. They also moved to dismiss the case.

However, Judge Frederick Stamp concluded that ERISA didn't apply because the disability policy was no longer connected to the policyholder's employer — and that she could pursue her bad faith claims in state court.

Judge Allows Unum Disability Benefits Dispute to Proceed

A West Virginia federal judge sided with a policyholder after Unum limited his disability to just 39 days despite medical evidence showing that he continued to be impaired due to alcohol addiction and bipolar disorder.

The policyholder had presented multiple medical opinions supporting his disability, but Unum relied on information provided by an in-house reviewer.

U.S. District Judge Joseph Goodwin found that Unum failed to conduct a "full and fair review" by ignoring outpatient treatment records that could affect the disability determination. He ordered the insurer to consider all relevant evidence.

WV Judge Finds Attorney Entitled to LTD Benefits

Unum sued a policyholder after paying him disability benefits for years, alleging that he had breached his policies by failing to provide information. The insurer sought to recover benefits already paid and cancel the policies.

The policyholder had worked as a lawyer before undergoing a sextuple bypass surgery at the age of 56 that resulted in serious cognitive impairments and memory problems, according to the court document.

U.S. District Judge John Bailey ruled that the evidence showed the man was permanently and totally disabled. He characterized Unum's demand for more information 3 years after the onset of disability as a "witch hunt."

He ordered Unum to continue paying benefits and greenlighted the policyholder's claims for bad faith, breach of contract, and intentional infliction of emotional distress.
